Terms of Use

These terms cover your use of Chews, an iPhone app published by twofox (Nischal Khadka). Installing or using the app means you accept them. They are written in plain language on purpose; the plain language is the agreement.

1. Your licence

Chews is free and has no in-app purchases. You get a personal, non-exclusive, non-transferable licence to use it on Apple devices you own or control, under Apple's Licensed Application End User License Agreement (the Standard EULA), extended by the EULA on this site. If anything here conflicts with the Standard EULA, the Standard EULA controls. Apple is not a party to these terms but may enforce them as a third-party beneficiary.

2. Accounts

You can use Chews as a guest, or sign in with Apple to claim an @handle, add friends and keep your profile across phones. You are responsible for what happens under your account and for keeping your device secure. One person, one account; do not impersonate anyone or claim a handle that belongs to a person or brand you are not. Chews is not for children under 13.

3. Sessions and invite codes

A session holds between two and four people, and anyone with its six-character code or invite link can join it while it is open. Treat a code like a dinner invitation: share it with the people you want at the table. The host can reveal the result early if someone stops swiping. Sessions and everything in them are deleted seven days after they are created.

4. Your content

Display names, handles, notes on shared places and trip names are yours. By adding them you give twofox a licence to store them and show them to the people the app is designed to show them to: your session, and your friends. That licence ends when you delete the content or your account. Do not add content that is unlawful, hateful, sexual, harassing, or that you do not have the right to share.

5. Fair use

• Do not use Chews to harass, stalk or deceive anyone, and do not enter a display name or handle you would not say out loud at dinner.
• Do not automate swiping, scrape the venue data, probe the backend, or attempt to read other people's swipes.
• Do not use the app where its use would be unlawful.

twofox may remove content, block accounts or end the licence of anyone who breaks these rules, and can do so without notice when necessary to protect other users.

6. Restaurant information

Venue data comes from Foursquare and Google Places. Opening hours, prices, ratings, reviews and photos can be out of date or wrong. Check before you travel; twofox does not warrant the accuracy of third-party data and is not responsible for your meal, your reservation or your journey.

7. Availability

Chews depends on services that can fail or change. If restaurant data is unavailable the app falls back to a designed deck so a session never dead-ends, but no uptime is promised, and the app is offered free of charge with no guarantee of future updates. twofox may change or retire features, or stop offering the app; if it does, your data is deleted as described in the privacy policy.

8. Your data

How Chews handles data, who can see it and how to delete it is set out in the privacy policy, which forms part of these terms.

9. No warranty and limitation of liability

Chews is provided "as is" and "as available", without warranty of any kind. To the fullest extent the law allows, twofox is not liable for lost data, missed reservations, disappointing meals, or indirect or consequential losses arising from use of the app. Nothing in these terms limits rights the law gives you as a consumer that cannot be limited by agreement.

10. Ending the agreement

You can stop using the app at any time by deleting your account and the app. twofox may end the licence if you materially breach these terms.

11. Governing law

These terms, and any dispute about the app, are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-law rules. You and twofox agree that the state and federal courts located in Maryland have exclusive jurisdiction over any such dispute. Nothing in this section takes away protections you have under the consumer laws of the place where you live that cannot be waived by agreement, and nothing in it limits Apple's rights under the Standard EULA. Before going to court, write to support@twofox.app: most problems are fixable with an email.

12. Changes to these terms

If these terms change, the new version is published at this address with a new date. Continuing to use the app after a change means you accept the updated terms.
